This sounds like a device a home owner may want to purchase and control, this way they have the evidence when they file claims. No one, however, should let an insurance company install one that the insurance company owns, monitors and controls.

You are assuming wrong.
Hospitals have patients sign piles of paperwork and one of those papers that you sign says that you are responsible for the entire bill and if the insurance doesn’t cover something you are promising to pay the hospital whatever the insurance doesn’t cover.
The penalties only apply if the person buys insurance through an exchange established by a state. If the state isn’t expanding Medicaid it likely isn’t establishing an exchange, so the feds will set one up in that state. You don’t have to be disabled in fact to get disability, you only have to be disabled on paper.
If your doctor uses the right key words or your lawyer refers you to doctors that fill out the forms the “right” way you will get disability, your actual physical condition isn’t relevant.
What’s worse is those that are collecting disability and taking jobs with government contractors in Iraq and Afghanistan.
