Restaurant sues over roadkill listing

I'm curious as to how the employee was "operating outside the scope of his job".  Was it because he was in sales and not proofing?  And it shouldn't matter if the "restaurant representative" was rude.  Sometimes, you HAVE to be rude to salesmen, otherwise they DON'T STOP calling!
