Are soda taxes the answer to the fiscal...

I'm an endurance athlete, most of the soda I drink is to refill my bike's three 24 oz water bottles after I've been riding ~120 minutes @ > 20 mph. Your take: Who pays the $200 ticket?

$200 for the first infraction? Or was this not the first infraction? I believe in California it is  a fine of not more than twenty dollars ($20) for a first offense, and a fine of not more than fifty dollars ($50) for each subsequent offense.
