If HSBC is too big to be prosecuted for money laundering under the Rico Laws, they why can't this guys acts of heroism be too big to prosecute as well?

The people of Nanking are completely to blame for what happened to them.  It's their own fault for not honorably committing suicide like any decent Japanese person would have done.
